1) With first degree <a href="http://criminal.laws.com/murder">murder</a> there is usually a premeditation with and afterthought of cruelty. There is usually some “malice aforethought”. This is the desire to kill or impose such bodily injury that the person dies. When a deadly weapon has been used, the intent to kill is being implied by the court.<br />
2) Second degree murder, for the most part, shows there was no premeditation. This is sometime changed to first degree if there is evidence that the person did intend to do bodily harm, and that harm directly caused the death. This is viewed as the equivalent of intent to kill when victim dies as a result of that harm.<br />
3) Third degree or <a href="http://criminal.laws.com/manslaughter">manslaughter</a> is the act to do harm which results in a death. This also has two classes in it voluntary manslaughter and involuntary. Voluntary is when a person kills another intentionally after being provoked. This is often a crime of passion, when the person had ben provoked to the point of losing all self-control. Involuntary manslaughter is the result of another being killed due to criminal negligence. Or, killing another during the commission of a crime when there was no intention to do harm.</p>
<p>The <a href="http://criminal.laws.com/general-criminal-law/death-penalty">death penalty</a> is one form of punishment that is extremely final. The laws vary from state to state in regard to these types of criminal behavior. This is also known as Capital punishment and is the premeditated, planned taking of a life by the government in response to the crime that was committed by that person. There is much debate about this, and people are divided with both pros and cons about it. Many states have a death penalty, and have never used it, or it is only extreme cases that make it to this point. Many feel that this is denial of human rights and is inhumane. Also, that it is barbaric and cruel, and a degrading form of punishment. Others will argue that it is fair and just punishment following an “eye for an eye”. That the <a href="http://criminal.laws.com/">criminal</a> has earned this punishment and that society has the responsibility and the right to protect the innocent by using this to prevent the criminal from killing again. In the United States, the death penalty has not been practiced as a regular form of punishment. Many of the people that had received this as their judgment from the court system have had it converted to life in prison. There are as many as 52 counties that include this form of punishment in their laws. The crimes that carry this sentence are widely varied across the world, from treason to theft and murder. In some places, even cowardice and desertion are included. With nearly 9,000 people sentenced to the death penalty, in 52 countries around the world, is it, not just an American punishment. Between the years, 1976 to 2009 in the United States there were 1,181 people that were put to death using the death penalty. Many states do not have a current death penalty as part of the forms of punishment.</p>
<p>The coroner is a person that performs the <a href="http://criminal-justice.laws.com/forensic-pathology">post mortem</a> examinations. There many cases, that will require a coroner to do this medical examination in order to determine the cause of a death. They are involved in many court cases as witnesses as to the definite cause of death. If a post mortem is ordered by a coroner, there is no right to the person not to have it preformed. In the case, of religious objections they should be told to the coroner before it is done. Once a death or murder is reported the first person to examine the body will be the coroner, they are the only one that will determine the cause of death. They will also make the determination as to if further investigation needs to be done for that case. That could mean that until he/she makes their decision a funeral cannot be done. A cremation would have to have permission from a coroner before it could be performed, as well. Post mortem examinations are done in a hospital and will show if the cause of death were natural or a potential murder. It will also show how the person died. If a legal inquiry is made this is done to determine the conditions of a death. If, it is an unnatural or violent death most cases will still only be determined after a post mortem had been performed.</p>
<p>The criminal act of murder is committed in various forms every day. Any person that unintentionally causes a death, can be charged with murder using the depraved- heart theory. This refers to a death as a result of gross negligence. An example of this would be if someone is shooting a gun in his own yard as target practice, and were to unintentionally kills someone. He can be charged with murder when gross negligence is proven. This example would be if a couple had thought of separation, and changed their minds. However, after reconciling he is showing her how he can carry a shotgun with a finger on the trigger, she suddenly stops and the shotgun goes off killing her. He claims he did not know it was loaded and maybe not be charged with a premeditated murder but could be charged, and convicted due to the gross negligence while handling the shotgun. Most felony murder charges are for crimes such as murder, burglary, rape, kidnapping and arson. A criminal that commits a specified felony maybe held responsible for any death that was caused by an accomplice during one of these crimes. As in the case of robbing a bank, one shoots, killing a guard, for example, during the flight from the crime all persons involved would be held accountable by association. Some states have circumstances that may increase the murder charge from second degree to first. Some of these include a killing for financial gain; using an explosive device; murder of any law officer, judge prosecutor or governmental official. Heinous or atrocious crimes that are cruel to the victim such as torture or poison by the criminal. If the death does, not by statute qualify as a first degree murder, it may be changed to second degree. This could be downgraded to even manslaughter if the facts involved are such that there was adequate provoking by the victim, and there is a lack of intent.</p>
<p>Keep in mind that Murder is homicide with distinguishing differences. Murder is always murder. Homicide is not it could be an unnatural death and may or may not be considered as a crime. When we hear the word murder we usually think it is referring to all homicides. This is not always the case. In order to be prosecuted for a crime of this class there has to be a trial and it needs to have been proven beyond a reasonable doubt by the jury and or judge. Many states have different break downs of these crimes and the jury and court system will make the determination as to what exactly the sentence will be. This could be anything from jail or prison time, to the death penalty depending on the state and severity of the crime committed by the criminal. The burden of proof is what the prosecutor has to prove, and there can be no qualm as to the chance that the criminal is not guilty.
